TORNADO QUEST, LLC – LEGAL NOTICE & TERMS OF SERVICE

PURPOSE

These Terms of Service (“Terms”) govern your access to and use of the Tornado Quest website, blogs, social‑media accounts, and any associated services (collectively, the “Site”). They are intended to define the rights and obligations of both Tornado Quest, LLC (“Tornado Quest”, “we”, “us”, “our”) and you, the user (“you”, “your”).

1. ACCEPTANCE OF TERMS

By accessing, browsing, or otherwise using the Site you affirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must immediately cease all use of the Site. Users under the age of 18 may only use the Site with the consent of a parent or legal guardian who agrees to these Terms on the minor’s behalf.

2. MODIFICATION OR DISCONTINUATION OF SERVICES

Tornado Quest may, at its sole discretion and without prior notice, modify, suspend, or permanently discontinue any portion of the Site or any service offered therein, whether free or paid. Such changes may affect your ability to access previously available content.

3. INTELLECTUAL PROPERTY

All content, designs, graphics, logos, trademarks, service marks, and software on the Site (collectively, “Content”) are the exclusive property of Tornado Quest or its licensors, unless expressly identified otherwise.

Limited Personal Use. You may download one non‑commercial copy of any Content for personal, offline reference.
Prohibited Uses. No Content may be reproduced, distributed, transmitted, displayed, performed, or otherwise exploited for commercial purposes without Tornado Quest’s prior written authorization.
Third‑Party Rights. All third‑party trademarks, logos, and copyrighted material remain the property of their respective owners.
Reverse Engineering. Decompiling, disassembling, or creating derivative works of any software or data on the Site is strictly prohibited.

4. USER‑SUBMITTED CONTENT

When you submit, post, or otherwise transmit any material to the Site (“User Content”), you represent and warrant that:

You own or possess all necessary rights, licenses, and permissions to grant the following license;
The material does not infringe any third‑party rights, violate any law, or contain defamatory, obscene, or hateful content.

You hereby grant Tornado Quest a world‑wide, perpetual, irrevocable, royalty‑free, sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, and display your User Content in any medium now known or later developed.

You agree to indemnify and hold harmless Tornado Quest, its officers, directors, employees, agents, and affiliates from any claim, demand, loss, liability, or expense (including reasonable attorneys’ fees) arising out of your User Content or any breach of these Terms. Tornado Quest reserves the right, in its sole discretion, to remove any User Content that it deems unlawful, infringing, or otherwise inappropriate.

5. TERMINATION

Either party may terminate this agreement at any time, with or without cause, by providing written notice to the other party. Upon termination, all licenses granted to you herein cease, and you must promptly discontinue all use of the Site. Termination does not relieve you of any liability incurred prior to termination.

6. DISCLAIMER OF WARRANTIES

THE SITE, ITS CONTENT, AND ANY SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TORNADO QUEST DISCLAIMS ALL EXPRESS, IMPLIED, STATUTORY, OR OTHER WARRANTIES, INCLUDING WITHOUT LIMITATION:

Merchantability, fitness for a particular purpose, and non‑infringement;
Accuracy, completeness, reliability, or timeliness of any data, especially third‑party weather or scientific data;
Availability, security, or error‑free operation of the Site.

7. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, TORNADO QUEST, ITS AFFILIATES, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

If you have entered into a paid transaction with Tornado Quest, the total aggregate liability shall not exceed the greater of (i) the amount you paid to Tornado Quest in the twelve (12) months preceding the claim, or (ii) $100 USD. Certain jurisdictions do not allow the exclusion or limitation of certain damages; in such cases, liability is limited to the maximum extent permitted by applicable law.

8. INDEMNIFICATION

You shall defend, indemnify, and hold harmless Tornado Quest, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, actions, demands, liabilities, losses, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to:

Your violation of these Terms;
Your User Content; or
Your use of the Site in violation of any applicable law or third‑party right.

9. THIRD‑PARTY LINKS & ADVERTISING

The Site may contain hyperlinks, advertisements, or references to third‑party websites or services. Tornado Quest does not endorse, guarantee, or assume responsibility for any such external content, products, or services, nor for the privacy practices of those sites. Accessing third‑party sites is at your own risk.

10. GOVERNING LAW, JURISDICTION & VENUE

These Terms shall be governed by and construed in accordance with the laws of the State of Oklahoma, United States, without regard to its conflict‑of‑law principles. Any dispute arising out of or relating to these Terms shall be resolved exclusively in the state or federal courts located in Oklahoma County, Oklahoma, and you hereby consent to the personal jurisdiction of such courts.

11. SEVERABILITY

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

12. MODERATION & ACCOUNT BLOCKING

Tornado Quest reserves the right, in its sole discretion, to suspend, terminate, or block any account or User Content that:

Violates these Terms;
Constitutes spam, phishing, or other fraudulent activity;
Contains illegal material (e.g., child exploitation, threats of violence);
Harasses, threatens, or defames any individual or protected class; or
Undermines the integrity, security, or proper functioning of the Site.

Decisions are final and not subject to appeal.

13. CHANGES TO THESE TERMS

Tornado Quest may amend these Terms at any time, in its sole discretion, without prior notice. Material changes will be posted on the Site with a 30‑day notice period; continued use of the Site after such notice constitutes acceptance of the revised Terms.

14. DMCA & IMAGE REMOVAL PROCEDURE

All images on the Site are presumed to be either in the public domain or used under a valid license, unless expressly noted otherwise. If you believe any image infringes your copyright, please submit a DMCA takedown notice to tornadoquest@protonmail.ch containing:

Your full name, address, telephone number, and email address;
Identification of the allegedly infringing material;
A statement that you have a good‑faith belief the use is unauthorized; and
Your electronic signature.

Upon receipt, Tornado Quest will act promptly to remove the material in accordance with the Digital Millennium Copyright Act.
